A Definition of Family Asset:
[Note: the following definition may no longer be "up-to-date" - however serves as a good initial reference - check with your family lawyer for the latest working legal definitions in your province as family laws related to assets vary from province to province across Canada]
"A matrimonial home and property owned by one spouse or both spouses and ordinarily used or enjoyed by both spouses or one or more of their children while the spouses are residing together for shelter or transportation or for household, educational, recreational, social or aesthetic purposes, and include,
(i) money in an account with a chartered bank, ... credit union or trust company where the account is ordinarily used for shelter or transportation or for household educational, recreational, social or aesthetic purposes,
(ii) where property owned by a corporation, partnership or trustee would, if it were owned by a spouse, be a family asset, shares in the corporation or an interest in the partnership or trust owned by the spouse having a market value equal to the value of the benefit the spouse has in respect of the property,
(iii) property over which a spouse has either alone or in conjunction with the another person, a power of appointment exercisable in the favour of himself or herself, if the property would be a family asset if it were owned by the spouse and
(iv) property disposed of by a spouse but over which the spouse has, either alone or in conjunction with another person, a power to revoke the disposition or a power to consume, invoke or dispose of the property, if the property would be a family asset if it were owned by the spouse, but does not include property that the spouses have agreed by a domestic contract is not to be included in the family assets."

Pre-Nuptial Agreements - some comments:
There are many good reasons for obtaining a pre-nuptial agreement. This is especially so if you are a parent and you have significant assets you may want to share with your children after they are married. Many parents want to ensure their assets remain "in the family" even in the event of a subsequent divorce.
Without a properly drawn pre-nuptial agreement, any assets transferred to a son or daughter risk becoming "family assets" which will be subject to division upon separation or divorce. Given the rate of marriage failures today, this is something every parent will want to consider.
If you are considering marriage and you or your fiancée have significant assets (and/or children from a previous relationship) then a pre-nuptial agreement may be crucial for preserving a separation of those assets and/or the financial security of your children from any previous relationship
